Elgar International Brass Band Summer School (EIBBSS)

(Trading as Elgar International Brass Symposium Ltd)

These are the standard terms of Elgar International Brass Band Summer School (EIBBSS), of 1A Church Walk, Areley Kings, Stourport on Severn, Worcestershire DY13 0AL and all work undertaken by EIBBSS shall be on these terms unless specifically varied in writing and agreed to by both parties prior to the event. EIBBSS reserve the right to make changes to terms  and conditions when required.

1. Event Booking Details

1.1 All bookings will be regarded as provisional until a completed copy of the enrolment form has been received from the delegate (herein called the ‘delegate’), along with a non-refundable deposit of £150 for the required services (as set out in Clause 2.4 below), and only if accepted by EIBBSS will the booking be confirmed. EIBBSS is not under any obligation to continue holding provisional bookings beyond the given option date (usually 10 working days from the time of booking) If these have not been received. For the purposes of this Agreement “working days” shall mean Monday to Friday inclusive.

2. Price & Payment

2.1 All prices quoted by EIBBSS may be amended when agreed with the delegate and the delegate will reasonably consider any errors or omissions or where an increase is caused by a change in the circumstances beyond the reasonable control of EIBBSS.

2.2 Any query arising from an invoice/payment reminder must be notified to EIBBSS in writing by the delegate within 10 working days of the date of the invoice/payment reminder receipt. Failure to comply will render the full invoice payable on the due date.

2.3 It is strictly the responsibility of the delegate confirming the booking to inform all relevant parties of the payment terms, as set out by EIBBSS.

2.4 Deposit – A deposit of £150 of the total fee payable (including VAT if applicable), as quoted and agreed in the enrolment form, of any event or programme shall be payable on confirmation of the order. The remaining sum shall be known as the “balance”.

2.5 Balance Due – the balance of the total fee shall be payable on or before the 1st of May prior to the commencement of the summer school. Failure to pay the balance by 1st May following a reminder sent by EIBBSS will result in EIBBSS considering your enrolment as cancelled. 

2.6  As no refunds can be made we recommend that you take out insurance to cover unforeseen circumstances. See clauses 3.2 & 3.3.

2.7 Additional Expenses – any additional expenses or fees resulting from any changes made by the delegate, that have not been quoted in the agreed proposal but subsequently incurred by EIBBSS, will be invoiced separately after the event. Payment will be due within 5 working days of presentation, any queries thereon raised within 3 working days of presentation and payment shall be made in accordance with Clause 2.9. EIBBSS will agree any additional expenses or fees with the delegate prior to these being incurred.

2.8 Late Bookings – Should a booking be made within 20 working days of the summer school date, payment in full will be required to secure the booking.

3. Cancellation

3.1 This clause applies where the delegate cancels the entire booking.

3.2  The  Deposit of £150 is non-refundable.

3.3 All bookings are non-refundable once the balance is received (1st May 2024) except in the case of Government restrictions –  see clause 3.6.

3.4 All cancellations must be received in writing from the delegate and will be deemed to take effect from the date of receipt.

3.5 Non payment of the balance by the due date (1st May) without mutual agreement from EIBBSS/Delegate will be deemed that your enrolment has been cancelled. The deposit is non-refundable.

3.6 Any postponements of confirmed and contracted business or any Public Health Emergency declared by Public Health England the Chief Medical Officer for England* or any law or any action taken by the UK government or UK public authority that directly affects the operation of the event will be considered as a cancellation in accordance with the above cancellation clauses. However, provided the revised summer school date is agreed (subject to availability) and takes place within 12 months of the original event date, payments received by EIBBSS from the delegate shall form a credit towards the future event. Should any postponement costs be incurred by EIBBSS, the delegate will be notified, and these costs will be deducted from the amount held as credit.

4. Liability

On external events (concerts etc..) all guests are fully supervised throughout. As such neither EIBBSS or its employees or agents shall be liable for any damage, loss, delay, or expenses caused to the delegate, its employees, agents, licensees or invitees or any other persons attending the event except insofar as it results from the negligence of EIBBSS or breach of contract. Please note that during particular events and on certain activities it may be necessary to request individuals to sign a liability waiver on the day of the event (although the same does not purport to exclude liability for damage to personal property of the delegates employees or staff or property damage caused to the delegates property or personal injury arising as a result of the negligence of EIBBSS), in which instances EIBBSS agrees to indemnify and hold the delegate harmless against all such claims. EIBBSS shall provide Public Liability insurance cover of £5million for each and every claim.

5. Force Majeure

EIBBSS shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God (other than one arising from or related to directly or indirectly from volcanic ash), strikes, lockouts, accidents, war, fire, breakdown of plant or machinery, and EIBBSS shall be entitled to a reasonable extension of its obligations.

6. Severance

If any term or provision of these Terms and Conditions is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

8.  Safeguarding Procedures

EIBBSS has its own Safeguarding Policy which is managed and updated by the Course Health & Safety Officer.

For the avoidance of doubt – the whole summer school/ course and accommodation is classified as “educational premises” for the duration of the course including arrival and departure. Relevant background checks and enquiries maybe undertaken to ensure child protection is maintained throughout.

9. Dietary Requirements

Although every effort will be made to accommodate special dietary requirements. However, should the cost of such be more than the catering costs there may be an additional charge levied by the caterers, but any additional charges will be notified to the delegate and agreed in advance.
